Terms of Use

The terms that govern access to and use of SaaS or Pass.

These Terms of Use (“Terms”) govern your access to and use of the SaaS or Pass website, anonymous swipe experience, founder dashboard, submission and capture tools, response-credit billing and related services (the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. The Service

SaaS or Pass serves two groups:

  1. visitors discover SaaS products and give fast first-impression feedback on landing-page screenshots through a time-limited swipe experience; and
  2. founders submit SaaS products, purchase response credits, set testing targets and view aggregated private feedback and results.

Each response is one visitor’s subjective opinion. A response, aggregate, click count or ranking is not a promise of representative market research, product-market fit, conversion performance, funding, revenue or commercial success.

3. Eligibility and accounts

The Service is not intended for children under 16. To create a founder account or make a purchase, you must be at least 18 or otherwise have the legal capacity and authority required to enter into these Terms. If you act for a company or another person, you confirm that you are authorized to bind them.

Visitors may use the public swipe and discovery experience without an account. Founder submissions, purchases and private reports require a passwordless email account. You must provide accurate account and billing information, keep access to your email and devices secure, and promptly tell us if you suspect unauthorized use. You are responsible for activity carried out through your account or browser session to the extent permitted by law.

4. Product submissions

You may submit only a public website that you own, operate or are authorized to submit. You represent that the URL, product information, names, trademarks, logos, page content and other materials you provide or make available through that site do not violate law or third-party rights and do not expose the Service to harmful code, deceptive activity or security risk.

You retain ownership of your website and underlying content. You grant SaaS or Pass a non-exclusive, worldwide, royalty-free and limited license to access the submitted public URL; follow its public resources and redirects; capture, store and reproduce desktop/mobile screenshots and site icons; extract and display product metadata; prepare AI-assisted drafts and review the submission; present the product to visitors; collect and aggregate responses; show eligible products and metrics in discovery and rankings; and promote the listing within SaaS or Pass itself.

This license lasts only as long as reasonably needed to operate the submitted listing and tests, provide reports, preserve integrity and lawful records, complete removal or backup cycles, and resolve disputes. It does not transfer ownership of your website or branding to us. You can request removal, but historical or aggregated records may remain where reasonably necessary and permitted by law.

Captured metadata and AI suggestions are drafts. You are responsible for checking the title, tagline, category, comprehension choices, screenshots and destination before confirming a submission. A changed URL, screenshot or question may create a new test version so earlier responses remain tied to the version people actually saw.

5. Responses, public results and rankings

Visitors may PASS, TRY, answer a comprehension question, provide an optional reason, skip a product or visit its website after responding. Individual opinions may be incomplete, mistaken, inconsistent or influenced by the visitor’s context. Founders must use results as directional first-impression feedback, not as a substitute for professional research or their own judgment.

We count only responses that complete required steps and pass integrity controls. We may reject, invalidate, exclude or recalculate responses affected by duplication, automation, manipulation, insufficient exposure, abuse, technical error or an inactive/full test. A rejected response does not consume a response credit.

Eligible products may appear in public discovery and rankings using valid-response thresholds and current integrity rules. Visitors may skip products. Rankings can change as new valid responses arrive, old windows roll forward, products or tests change status, or integrity issues are corrected. We may reasonably adjust eligibility, moderation and anti-abuse logic to protect the system. No product is guaranteed inclusion or a ranking position.

Credits buy access to eligible valid responses. They never buy a positive verdict, score, rank, endorsement or competition outcome. Payment history, target size, credit balance, clarity, visits and raw clicks do not determine ranking position.

6. Response credits, purchases and refunds

SaaS or Pass currently sells one-time response-credit packages, not subscriptions. The available package, credit quantity, price, currency and taxes are shown before purchase and may change for future purchases. There is no recurring charge unless we introduce one under separate terms and obtain any required agreement.

A response credit funds one valid completed response allocated to an eligible test. Credits are added only after Stripe confirms successful payment through our verified fulfillment process. Canceled, abandoned, pending or failed checkout attempts do not add credits. Credits have no cash value, are not transferable and are not currently subject to an expiry date. Welcome or product-bound included responses may have different allocation and refund rules from flexible purchased credits.

Starting a test reserves its target from available flexible credits. A target may be increased if sufficient credits are available, but it cannot be decreased after launch. Pausing a test keeps its reservation. Archiving or rejecting a test returns only the unfulfilled flexible reserved portion; unused product-bound included responses remain tied to that eligible site/domain.

Stripe handles payment methods, billing addresses, supported VAT/tax IDs, automatic tax calculation and post-purchase invoices. You are responsible for accurate billing and tax information. The billing portal may be used to update legal billing information and download invoices.

Refund eligibility depends on the circumstances and applicable law. We do not impose an absolute no-refund rule, and nothing in these Terms limits mandatory consumer rights. A confirmed full refund automatically reverses the purchased credits if enough unreserved credits remain. If credits have already been reserved or used, the account enters review so we can resolve the credit balance and refund consistently and lawfully.

Consumers in the EU or EEA may have a statutory withdrawal right for a distance contract. Any loss or waiver of that right for immediate digital content or service performance applies only where the legally required express request or consent, acknowledgement and confirmation have been obtained. Contact support@saasorpass.now to request a withdrawal, cancellation or refund review. We may ask for purchase details needed to identify the transaction.

7. Acceptable use

You must not:

  • use bots or automation to submit, scrape, vote or manipulate responses, results or rankings;
  • evade one-response controls by clearing, cycling or forging identities, sessions, challenges or requests;
  • interfere with Turnstile, rate limits, signed feed controls, access restrictions or security systems;
  • probe, attack, overload, reverse engineer or disrupt the Service where prohibited by law;
  • submit malicious, deceptive, private-network or unauthorized URLs;
  • submit illegal, infringing, harmful, abusive, adult, gambling, fraudulent or spam content;
  • impersonate others or misrepresent ownership, affiliations, endorsements or product claims;
  • scrape or reuse the Service beyond reasonable public use or an express permission; or
  • engage in fraudulent payment, refund or credit activity.

8. Moderation and integrity action

We may reject a submission, require changes, pause or remove a public listing, invalidate fraudulent or technically defective responses, correct ranking/data-integrity issues, remove illegal or infringing content, restrict abusive sessions, or suspend an account when reasonably necessary to protect the Service, users, third parties or legal compliance.

Automated systems may approve clearly eligible software pages, but uncertain or risky cases are routed for review and AI does not automatically reject a product. We do not promise to proactively review every submission or detect every violation. To report a listing or challenge a moderation action, contact us with enough information to investigate.

9. Third-party websites and services

SaaS or Pass intentionally links to independently operated SaaS websites. A listing, response aggregate or ranking is not our endorsement, certification or warranty. Third-party websites are governed by their own terms and privacy practices, and you visit them at your own discretion.

The Service also depends on third-party infrastructure for payments, email, bot protection, AI, storage, capture and hosting. Those services may be unavailable, changed, rate-limited or discontinued. Their own terms and privacy notices apply when they process information in their independent roles.

10. AI-assisted content

AI may suggest a category and comprehension answers, screen submission content, and recommend approval or human review. AI output may be inaccurate, incomplete, unsuitable, non-unique or based on a mistaken reading of a landing page. Founders must review and edit drafts before confirming them. AI output is not legal, commercial, research or other professional advice, and no decision should be based on it without appropriate human judgment.

11. SaaS or Pass intellectual property

Except for founder submissions and third-party materials, the Service—including its software, interface, design, text, branding and underlying technology—is owned by or licensed to Suelo Piotr Osmola and is protected by applicable intellectual-property law. These Terms grant only a limited, revocable, non-transferable right to use the Service as provided. They do not grant ownership of SaaS or Pass or a right to use its branding outside normal references to the Service.

12. Privacy

Our Privacy Policy explains how we process account, anonymous swipe, submission, payment and security information. It forms part of the context in which the Service is provided but does not reduce any rights granted by applicable data-protection law.

13. Service changes and availability

We may reasonably add, change, limit, suspend or discontinue features, package availability, response rules, ranking methods or provider integrations. We may perform maintenance or respond to outages and security issues. We aim to operate a useful and reliable Service, but do not promise uninterrupted availability, error-free operation, permanent storage, continued availability of every product listing or support for every third-party service.

Changes that materially affect an existing paid purchase or mandatory consumer right will be handled subject to applicable law.

14. Disclaimers

The Service is a first-impression feedback and discovery tool. To the extent permitted by law, it is provided “as is” and “as available.” We do not guarantee that responses are accurate, representative, statistically significant or free from all manipulation, or that use of the Service will produce conversion lift, product- market fit, funding, revenue, a ranking position or any other business result.

We do not guarantee the availability, safety, legality or accuracy of submitted third-party sites or founder-provided claims. Nothing in these Terms excludes a warranty or remedy that cannot lawfully be excluded, including mandatory consumer rights.

15. Limitation of liability

To the maximum extent permitted by law, Suelo Piotr Osmola is not liable for indirect, incidental, special or consequential loss; lost profits, revenue, opportunity, goodwill or data; business interruption; or loss arising from subjective feedback, ranking changes, third-party websites, AI output, unauthorized submissions or external providers.

To the maximum extent permitted by law, our aggregate liability for claims relating to the Service is limited to the greater of EUR 100 or the amount you paid to SaaS or Pass in the 12 months before the event giving rise to the claim. This limit does not apply to liability that cannot lawfully be limited or excluded, including liability for fraud, willful misconduct, or death or personal injury caused by negligence where applicable.

16. Suspension, termination and removal

You may stop using the Service at any time and may request account deletion through account settings. We may suspend or terminate an account or session, or pause/remove a submission, for material breach, abuse, fraud, security risk, non-payment, illegality, infringement, provider requirement or a legal obligation. Where reasonable and lawful, we may give notice or an opportunity to correct the issue.

On deletion or termination, access to private reports and unused features may end. Public listings may be removed, and founder-owned records are handled under our current deletion flow and Privacy Policy. Payment, invoice, dispute, security, audit, aggregated or anonymized records may remain where necessary and permitted by law. Terms that by their nature should survive—such as ownership, payment, disclaimers, liability limits and dispute provisions—continue to apply.

17. Governing law and disputes

These Terms are governed by the laws of Poland, without regard to conflict-of-law rules. If you are a consumer in the EU or EEA, you keep the mandatory protections and rights of the courts available to you under the law of your country of residence. Nothing here prevents either party from seeking an urgent protective remedy or using another mandatory dispute process.

Before starting formal proceedings, please contact us so we can try to resolve the issue, unless doing so would prejudice a right or deadline.

18. Changes to these Terms

We may update these Terms as the Service or applicable requirements change. The date at the top identifies the latest version. If a change is material, we may provide additional notice through the Service or by email where appropriate. Changes do not retroactively remove rights that already apply to a completed purchase.
